paying support or alimony, is not letting you visit the children, or is not doing anything else.ordered in the divorce decree.

To get an order on your husband, you must file a Motion to Show Cause with the court. The court will hold a hearing. You should bring with you to the hearing witnesses, papers, and receipts showing how your husband is disobeying the divorce decree. If your husband continues to disobey after the hearing, you will have to ask for another hearing. Your husband eventually may be fined or sent to jail. This does not happen very often. I isted below are other ways to get your husband to go along with the order. CHILD SUPPORT

The easiest order to get a court to enforce is child support. At the hearing to show cause, the court will decide how much your husband owes in back support. payments. This is called arrearage,

I either you or the judge thinks your husband will not pay, the judge can order your husband's employer to pay part of his salary as child support. (This can also be ordered at the time of the divorce.) This can be used for both past and future child support.

Enforcement will be harder if your husband is not working. The court will not order him to pay money if he does not have it,' If your husband owns any property, you may get a judge to order a sale of it to pay child support. This is a long and drawn-out process and can be used only for past support,

Husband Out of State

If your husband is out of state and you know where he can be found, you can get child support enforced, but it is very hard. First you must go to the Uniform Reciprocal Enforcement and Support Office (URESA), and they will help you get the past support (listed in the Appendix). To help the 'URESA office, bring anything that will help them find your husband (i.e., social security number, pictures, addresses, and a certified copy of your divorce decree). The lawyers at that office will help you at no charge.

Whether or not you actually get child support will depend on the court in the state where your husband is. Some states are very helpful; others are not.

ALIMONY

Alimony is much harder to enforce than child support. A Domestic Relations judge cannot order an employer to take money from a husband's wages to pay alimony. To get the alimony taken from his wages, you will have to go through a show cause hearing to get a judgment. Then you must go through an action called garnishment in another court.

If your husband is not working but has property, you have to do the same things as in child support in order to get the judge to order the sale of the property.

NOTE: Neither garnishment nor the sale of property can be used for future payments; they can be used only to collect past alimony.

If your husband is out of state, it is almost impossible to enforce an alimony order. You should see a lawyer if you are in this situation.

CUSTODY

After the court has given you custody of the children, your husband might take them anyway. To get them back you must know where he is. You should immediately do two things:

1. Go to the county prosecutor's office and file criminal charges.

2. File a Motion to Show Cause in Domestic Relations court.

There will be a hearing in Domestic Relations court. If your husband has no good reason for laking the children away, the court will order him to give them back. If he does not, he can be put in jail.

COMMON LAW MARRIAGE

A common law marriage in Ohio is as legal as if you got a license and went through a ceremony. Generally, you are married common law if:

1. You and your husband verbally agree that you are married; and

2. You and your husband live together—it does not matter for how long; and

3. You tell other people that you are wife and husband; and

4. Other people think that you are married.

To end a common law marriage, you must get a divorce. If you do not, and later marry someone else, this second marriage can be annulled. To prove that you are married common law, the following things may be used: a wedding band, a lease signed in both your names, joint bank accounts, and use of your husband's name.

Children of a common law marriage are legitimate.

ILLEGITIMATE CHILDREN

An illegitimate child is one born to parents who are not married to each other. There are two ways to make an illegitimate child legitimate:

1. The mother and father marry each other, or 2. The man legally claims that he is the father of the child. This is done through the Probate Court. The mother must agree to this.

Both parents must support the child. If the child has been legitimatized, the father can be ordered to pay child support. If the child has not been legitimátized, the mother must file a paternity suit in Juvenile Court to get the father to pay child support. In a paternity action, the mother tries to prove that a certain man is the father of the child. If the judge or jury finds that he is the father, he will be ordered to pay child support. A paternity action will not legitimatize the child.
